Terms and Conditions of Sale

1. Who we are and definitions
These terms and conditions of sale (the "Terms") apply to every order placed on ninonandco.com (the "Site"), operated by Maison Ninon LLC, a Wyoming limited liability company, operating as Ninon & Co. ("we", "us", the "Seller"). Customer service: contact@ninonandco.com; our postal address is in our Legal notice.
"Products" means the physical goods offered for sale on the Site. "Customer" or "you" means the person placing an order. Please read these Terms carefully and save or print a copy before ordering. By placing an order you confirm that you have read and accept them. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
2. Scope and changes
We may update these Terms at any time by publishing a new version on the Site; the version in force when you place your order applies to that order. The Site sells clothing and accessories intended primarily for women. Access to the Site is free. To order you must be at least 18 years old or have the permission of a parent or guardian.
3. Customer service
Our customer service is available by email at contact@ninonandco.com and through the contact form on the Site. Please include your name, your order number and the reason for your message. Business inquiries (press, partnerships, commercial proposals) are handled by email only.
4. Placing an order
The Products offered are those shown in the catalog on the Site, each with a description prepared by us on the basis of information supplied by the manufacturer. Photographs are for illustration only: colors and details may differ slightly from the actual Products because of screen settings, lighting and angles.
You add Products to your cart, check its contents and correct any errors, enter your contact and shipping details, choose a shipping method, enter your payment details and billing address, add any discount code, and review a full summary before confirming. You are responsible for the accuracy of the information you enter. The contract between us is formed when you click the order button, accept these Terms and your payment is authorized; we will then send you an order confirmation by email. We may refuse or cancel an order where we reasonably suspect fraud, where a Product is unavailable, or where a pricing or description error has occurred, in which case we will refund any amount paid.
5. Prices, taxes and payment
Prices are shown in US dollars and do not include sales tax. Any applicable sales tax and shipping charges are shown before you confirm your order. We may change prices at any time, but the price shown when you place your order is the price you pay. Payment is taken in full at the time of ordering by credit or debit card, Apple Pay, Google Pay, PayPal or any other method offered at checkout. Payments are processed by secure third-party payment providers; we never see or store your full card details. We keep order confirmations and invoices as electronic records, which constitute valid evidence of the transactions between us.
6. Shipping
We ship to addresses in the United States. Delivery times are estimates: most US orders arrive within 2 to 4 weeks of purchase, as explained in our Shipping Policy. If we expect your order to ship later than stated, we will email you with a new estimate and you may cancel the unshipped items for a full refund. If your order has not been delivered within 30 days of purchase, you may cancel it and receive a full refund. Risk of loss passes to you when the Products are delivered to the address you gave. If a package is returned to us because of an incorrect address, a refused delivery or a package not collected, we will contact you to agree on a refund (less the original shipping cost) or a re-shipment at your cost.
7. Returns
You may return Products for any reason within 30 days of delivery, under the conditions set out in our Refund & Returns Policy. Our fulfillment warehouse is located in China; return shipping, typically $35 to $65, is at your cost, and a tracked service is strongly recommended. Worn items, gift cards and digital products cannot be returned. Discounted Products are refunded at the price actually paid.
8. Faulty products and warranties
If a Product is faulty, damaged on arrival or not as described, contact us at contact@ninonandco.com within 30 days of delivery with your order number and photographs. You may choose a replacement or a full refund, and return shipping is at our expense. Except as stated in these Terms and to the extent permitted by the law of your state, we give no other express warranties. Some states do not allow limits on implied warranties, so this limit may not apply to you.
9. Health information
Information on the Site is provided for general purposes and is not medical advice. Our Products are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, recovering from surgery, have a medical condition, a pacemaker or other implanted device, or have any doubt about whether a Product is suitable for you, consult your doctor before using it.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, for business losses, or for loss of profit, revenue, data or goodwill, and our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms limits our liability for personal injury caused by our negligence, for fraud, or for anything for which liability cannot be limited by law. Some states do not allow these limits, so they may not apply to you. Minor differences between the Products and their images or descriptions do not constitute a breach of these Terms.
11. Events outside our control
An event outside our control means any event that neither party could reasonably foresee or avoid and that makes performance impossible or substantially more difficult (for example strikes, transportation disruption, epidemics, natural disasters, government action). Our obligations are suspended while such an event continues. If it lasts more than 90 days, either party may cancel the affected order by written notice, and we will refund any amounts paid for Products not delivered.
12. Intellectual property
All content on the Site, including texts, images, videos, illustrations, logos, graphics, product names and designs, belongs to Maison Ninon LLC or to third parties who have authorized its use, and is protected by copyright, trademark and other intellectual property laws. You may use the Site for personal, non-commercial purposes only. Copying, reproducing, distributing, modifying or otherwise exploiting any part of the Site or its catalog without our prior written consent is prohibited and may give rise to legal action.
13. Personal information
We process your personal information to fulfill your order, to communicate with you and to improve the Site, as described in our Privacy Policy. You may exercise your privacy rights by emailing contact@ninonandco.com.
14. Reviews and feedback
If you send us ideas, suggestions, reviews, photographs or other content, whether at our request or spontaneously, you grant us a non-exclusive, worldwide, royalty-free and perpetual license to use, reproduce, adapt, publish, translate and display that content on any medium. We are not obliged to keep it confidential, to pay for it, or to respond to it, and we may remove it at any time.
15. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force. These Terms replace any previous terms on the same subject. You may not transfer your rights under these Terms without our written consent. If these Terms are made available in several languages and there is a conflict, the English version prevails.
16. Governing law and disputes
These Terms and any contract formed under them are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules, and without prejudice to the mandatory consumer protection laws of the state where you live. If you have a complaint, please contact us first at contact@ninonandco.com; we aim to resolve every issue amicably. We reserve the right to take legal action in the event of attempted fraud or unlawful use of a payment method.
17. Customers outside the United States
Orders placed before October 30, 2026 remain governed by the terms in force on the date of the order. If you live outside the United States, the mandatory consumer rights of your country of residence continue to apply.
